Terms of Service
Last updated: November 8, 2026
These Terms of Service ("Terms") are a binding agreement between you and HYPERSMARTY LLC, an Illinois limited liability company ("Jackpot Boardwalk," "we," "us"), and govern your use of the Jackpot Boardwalkwebsite, apps and games (the "Service"). By playing, creating an account or making a purchase, you agree to these Terms and our Privacy Policy.
PLEASE READ SECTION 17 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS. YOU CAN OPT OUT WITHIN 30 DAYS AS DESCRIBED THERE.
1. Entertainment only: no real-money gambling
Jackpot Boardwalk is a free-to-play social casino for entertainment only. It does not offer real-money gambling or any opportunity to win real money, cash, or prizes. Coins have no cash value and can never be redeemed, exchanged, or transferred. Practice or success at social casino gaming does not imply future success at real-money gambling.
The Service does not offer sweepstakes, redemptions, cash prizes, gift cards, merchandise or any other prize of value, and no contest or competition for anything of value. Missions, leaderboards and races award only more coins, which have no value. Nothing in the Service is an offer or solicitation of gambling. Coins, levels, bonuses and other virtual items are an in-game score and play currency with no value of any kind, inside or outside the Service.
2. Eligibility
- You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Service.
- You may not use the Service where it is prohibited by law. You are responsible for following the laws that apply to you.
- Where we operate: the Service is offered only in the United States, Canada, the United Kingdom, Ireland and New Zealand. It is not offered to residents of, or people located in, the State of Washington or the Province of Quebec, or in any other place we designate. We may change this list at any time.
- You may not use a VPN, proxy or other tool to hide your location or to access the Service from a place where it isn't offered. Purchases made from, or billed to, a restricted location will be refunded and the coins removed, and the account may be closed.
- You may not use the Service if we have previously closed your account, or while you are on a self-exclusion break.
3. Accounts
You can play as a guest on one device. A guest account is tied to your browser and may be lost if you clear your data. Creating an account with a verified email lets you keep progress across devices and is required to make purchases. You are responsible for keeping your password confidential and for activity on your account. Tell us right away at customerservice@jackpotboardwalk.com if you believe your account has been compromised. One person may not operate multiple accounts to collect extra bonuses.
4. Coins and other virtual items
- Coins and other virtual items are licensed, not sold. We grant you a limited, personal, non-transferable, non-sublicensable, revocable license to use them within the Service for entertainment. You do not own them and have no property interest in them.
- Virtual items have no monetary value and cannot be redeemed, cashed out, sold, transferred, gifted or exchanged for money, goods, services or anything of value, inside or outside the Service, by you or anyone else.
- Buying, selling or trading coins or accounts, including through third-party websites, is prohibited and may result in account closure without refund.
- We may manage, regulate, change or remove virtual items, prices, bonuses, payouts and game features at any time, and you agree we have no liability for doing so. Virtual items are forfeited when an account is closed or deleted. Coins in an account with no activity for 24 consecutive months may be removed.
5. Purchases
- Purchases are processed by third parties such as Stripe, Apple or Google, and are subject to their terms. Prices are shown in U.S. dollars before you pay and may include applicable taxes.
- All purchases are final and non-refundable except as described in our Coins & Refunds Policy or as required by law. Where the law of your country gives a right to withdraw from a digital content purchase, you request immediate delivery and acknowledge that you lose that right once the coins are delivered to your account, to the extent the law allows.
- If a purchase is refunded or charged back, we will remove the corresponding coins (which can bring your balance to zero) and may suspend purchasing or close the account.
- You never need to buy anything to play. Free coins are given at sign-up, every 3 hours (every hour when your balance runs out) and every day, and every game can be played with free coins alone. Purchases are optional and only add more coins or cosmetic convenience; they never improve the odds of any game.
- You can set daily, weekly and monthly spending limits in Account → Responsible Play. We may also limit or decline purchases at our discretion.
5A. Boardwalk Club memberships (automatic renewal)
- Boardwalk Club memberships are monthly subscriptions that renew automatically at the monthly price of the membership you choose (plus any applicable tax) until you cancel:
- Boardwalk Club: $4.99 per month. A Club Chest of 300K coins once a day, a 2x free bonus, and 10% off the price of every coin pack.
- Gold Club: $9.99 per month. A Club Chest of 750K coins once a day, a 2x free bonus, and 20% off the price of every coin pack.
- VIP Club: $19.99 per month. A Club Chest of 1.5M coins once a day, a 3x free bonus, and 30% off the price of every coin pack.
- Member discounts apply to coin packs bought while the membership is active and are shown at checkout. Benefits are virtual coins and discounts with no cash value, governed by Section 4. We may change membership benefits with notice; if a change is materially worse for you, you may cancel and request a prorated refund for the unused part of the current month.
- How to cancel: online at any time in Account → Boardwalk Club → Cancel membership (one click), or by emailing customerservice@jackpotboardwalk.com. Cancellation stops the next renewal; your benefits continue until the end of the month you already paid for. Except where the law requires otherwise, we don't give partial refunds for the remaining days of a month.
- After you join we email you a confirmation with these terms and the cancellation steps. Taking a self-exclusion break automatically stops renewal, and deleting your account ends the membership right away.
- If a renewal payment fails, we may retry it for a short period; benefits may pause until payment succeeds. Refunded or charged-back membership payments end the membership.
6. Game play and outcomes
Game outcomes are determined on our servers by a random number generator. Theoretical return rates are published on our Game Rules page and describe very long-run averages, not any single session. In the event of a malfunction, error, interruption or display problem, our server records control and we may void affected plays and correct balances. We are not responsible for coins lost because of connection problems or device issues.
7. Rules of conduct
You agree not to:
- use bots, scripts, automation, cheats, exploits or modified clients, or reverse engineer the Service;
- exploit bugs instead of reporting them to customerservice@jackpotboardwalk.com;
- create multiple accounts or use VPNs, proxies or false information to get around location rules, limits or bonuses;
- buy, sell, trade, rent or give away accounts or virtual items, or offer real-world value for them;
- let anyone under 18 use your account;
- harass others, use offensive display names or impersonate anyone; or
- interfere with the Service, its security or other players.
8. Responsible play
We want Jackpot Boardwalk to stay fun. We offer spending limits, play-time reminders and self-exclusion (see Responsible Play). If you choose self-exclusion, play, purchases and promotional email are blocked for the period you select, and the break can't be ended early.
9. Communications
We send service emails such as account confirmation, password resets and receipts. Promotional email is sent only if you opt in, and every promotional email has an unsubscribe link.
10. Intellectual property
The Service, including its software, game designs, text, graphics and the Jackpot Boardwalk name and logo, is owned by HYPERSMARTY LLC or its licensors and protected by law. Some artwork is from Google's Noto Emoji project, used under the Apache License 2.0. Except for the limited license in these Terms, no rights are granted to you.
11. Feedback
If you send us ideas or feedback, we may use them without any obligation to you.
12. Suspension and termination
You may stop using the Service and delete your account at any time in Account settings. We may suspend or close accounts, remove virtual items or refuse service if we reasonably believe you broke these Terms, created risk or legal exposure for us, or if required by law. Where appropriate we will tell you. Sections that by their nature should survive termination will survive.
13. Changes
We may change the Service or these Terms. If a change is material, we will post the new Terms with a new date and, where appropriate, notify you in the Service or by email. Continuing to use the Service after changes take effect means you accept them. Changes to Section 17 will not apply to disputes we already know about.
14. Disclaimers
THE SERVICE AND VIRTUAL ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HYPERSMARTY LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL OR VIRTUAL ITEMS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM AROSE OR (B) US$50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT FULLY APPLY TO YOU.
16. Indemnity
To the extent permitted by law, you will defend and indemnify HYPERSMARTY LLCagainst claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the Service.
17. Dispute resolution, arbitration and class-action waiver
This Section 17 applies only if you live in the United States. If you live in Canada, the United Kingdom, Ireland or New Zealand, it does not apply to you, and you may bring a claim in the courts where you live under your local consumer law.
17.1 Informal resolution first
Before filing a claim, you and we agree to try to resolve the dispute informally. Send a written notice with your name, account email, a description of the dispute and the relief you want to info@jackpotboardwalk.com or to HYPERSMARTY LLC, 6615 Grand Ave 1135, Gurnee, IL 60031, USA. If it isn't resolved within 30 days, either party may start arbitration.
17.2 Binding individual arbitration
Except as stated below, any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act governs this Section. The arbitrator may award the same individual relief a court could. For claims under US$10,000 that are not frivolous, we will pay the AAA filing, administrative and arbitrator fees. Arbitration may be held by video, by phone, based on written submissions, or in the county where you live.
17.3 Exceptions
Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.
17.4 Class-action and jury-trial waiver
YOU AND WE AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING, AND YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. If this waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration, after the individual arbitration of all other claims.
17.5 Mass filings
If 25 or more similar demands are filed by or with the help of the same law firm or organization, the demands may be administered in batches of up to 25 under the AAA's mass arbitration procedures, and the statute of limitations is paused for demands waiting to be heard.
17.6 30-day opt-out
You can opt out of this arbitration agreement by emailing info@jackpotboardwalk.comfrom your account email within 30 days of first accepting these Terms, with the subject "Arbitration Opt-Out." Opting out does not affect any other part of these Terms.
18. Governing law and venue
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 17. For any claim not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Lake County, Illinois. If you are a consumer in a country whose law gives you the right to bring claims in your home courts or under your local consumer law, nothing here removes that right.
19. Apple App Store and Google Play
If you download the Service from an app store, these Terms are between you and HYPERSMARTY LLC, not Apple or Google. Apple and Google have no obligation to provide maintenance or support and are not responsible for the Service or any claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Purchases made through an app store are also subject to that store's refund rules.
20. General
These Terms, together with the policies linked here, are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. There are no third-party beneficiaries except as stated in Section 19.
